Premises Liability-Dangerous Property

The information provided in the following articles is for information purposes only. If you feel you have a personal injury case, please contact us for a FREE case evaluation.

Premises liability is synonymous with a dangerous property or with facing a danger on a property. Premises liability refers to both commercial and residential properties. Classic examples of premises liability cases are:
  • Slip and fall accidents in business establishments such as grocery stores, department stores, office buildings, restaurants, parking lots, and gas stations
  • Slip and fall accidents in residential properties such as apartment buildings
  • Trip and fall accidents in the business establishments and residential properties
  • Defective sidewalks or walkways
  • Defective staircases and missing handrails on stairways of office and apartment buildings
  • Inadequate lighting on stairways and walkways
  • Animal attacks such as dog bites
  • Accidents involving swimming pools
  • Accidents on playgrounds
  • Accidents on amusement parks or the like
  • Assaults, failure to provide adequate security or security failing to act reasonably under the circumstances

Under premises liability law, the owner or possessor of the property may be held responsible for injuries that occurred on the premises if the owner or possessor failed to make and keep the property safe of dangerous conditions, and failed to adequately warn about dangerous conditions that they knew or should have reasonably known about.

Insurance companies retain defense attorneys to fight claims brought against property owners and possessors. These defense attorneys and the insurance companies often, if not always, argue that the property owner or possessor did not have notice of the dangerous condition, thereby downplaying the potential value of the case. This is why you need someone on your side to stand up against the insurance company and to protect you and your rights.

We have handled countless premises liability cases including slip and falls, defective walkways and defective staircases, accidents on playgrounds and accidents on amusement parks, swimming pool accidents, dog bites, assaults resulting from a security guard's failure to act properly, and even an electrocution incident resulting from a downed power line.

If you have been injured as a result of a dangerous condition located on someone else's property, please give us a call.
